Terms of service

The terms that govern use of Sunup by activity providers and the families who register through them.

Acceptance of these terms

By creating a Sunup account or using the service, you agree to these terms. If you're agreeing on behalf of a business, you confirm you're authorized to bind it. If you don't agree, don't use Sunup.

The service

Sunup provides software for children's activity providers to publish classes, take registrations and payments, and manage rosters, attendance, and a parent portal. We may improve and change the service over time; we won't materially reduce core functionality your plan depends on without notice.

Accounts & responsibilities

You're responsible for your account, your staff's access, and the accuracy of what you publish and collect. As a provider, you're the controller of the family data you gather through Sunup and are responsible for having a lawful basis to collect it and for honoring the permissions families set.

Keep account credentials secure and limit staff access to what each role needs
Provide accurate class, pricing, and policy information to families
Use children's information only for running your program

Fees & payments

Plan fees and the platform fee are described on our pricing page. Payment processing runs through Stripe at cost, and funds settle to your own Stripe account — you are the merchant of record for transactions with your families. Parents are never charged a booking fee by Sunup.

Refunds you issue are processed through Stripe and recorded against the original order. Provider plan fees are billed in advance and are non-refundable except where required by law.

Your data

Your data is yours. We process it to provide the service, as described in our privacy policy, and never sell it or use it for advertising. You can export your data, and we'll return or delete it on termination in line with our retention practices.

Acceptable use

Don't use Sunup to break the law, infringe others' rights, misuse children's information, attempt to disrupt or reverse-engineer the service, or send unsolicited marketing through it. We may suspend accounts that put families' data or the service at risk.

Term & termination

You can stop using Sunup at any time. Either of us may terminate for material breach that isn't cured after notice. On termination we'll help you export your data, and safety and accounting records are retained as required by law before deletion.

Warranties & liability

The service is provided "as is" to the extent the law allows, and our liability is limited as set out in the full terms. Nothing here excludes liability that can't lawfully be excluded. Final language for this section must be prepared with counsel.

Changes to these terms

We may update these terms as the service evolves. If a change is material, we'll give reasonable notice before it takes effect. Continuing to use Sunup after that means you accept the updated terms.
